Energy Compliance for Tertiary Buildings

The Tertiary Decree, stemming from the ELAN law, requires a progressive reduction in energy consumption in tertiary-use buildings. It commits all affected owners, landlords and occupants to a measurable energy performance trajectory aligned with the carbon neutrality objectives of the French real estate stock.

To meet these requirements, GA Smart Building deploys complementary expertise through GA Rénovation, specializing in modernization and energy renovation projects, and GA Property Management and Services, expert in technical operation, energy monitoring and regulatory reporting. This integrated organization enables full support, from the initial audit to the annual performance tracking.

The decree sets three energy consumption reduction targets compared to a reference year between 2010 and 2019: –40% by 2030, –50% by 2040 and –60% by 2050. Energy data must be reported annually on the OPERAT platform managed by ADEME.

The regulation applies to tertiary buildings over 1,000 m² (offices, retail, healthcare, education, hospitality, etc.), including those within multi-building complexes. It applies to both owners and operators.

In the event of non-compliance, administrative and financial penalties may be imposed, along with a public disclosure mechanism (“name & shame”), without exemption from the obligation to comply.

Beyond the regulatory requirement, the Tertiary Decree represents a strategic lever for enhancing asset value, reducing operating costs, improving occupant comfort, and strengthening rental attractiveness.
